Rogue letting agent Manish Manek was found guilty of 17 counts of theft involving tenants’ deposits and rent owed to landlords. He stole £47,000 before fleeing the UK in October 2012. A police investigation found that Manek had been putting tenant deposits and rent into his personal account. He was finally arrested and sentenced to jail leaving landlords and tenants out of pocket.
His victims never saw their money returned.
Money Shield will reimburse landlords and tenants who are out of pocket up to £5 million per year with a maximum award of £50,000 per individual claim. Unfortunately, we cannot make payments for any loss arising from war, terrorism, confiscation or nuclear risks.
The Government is taking action to protect landlords and tenants by making CMP mandatory. All agents managing lettings in England will need to belong to an approved CMP scheme by 1 April 2019. Agents in Scotland and Wales are already required to hold CMP.
The issue`s of health and safety have been a grey area for many organisations. We pride in ensuring that the safety of tenants prior to the start of the tenancy commencing is 100% up-to-date.
We will ensure that all Gas appliances are inspected and regulated by a registered Gas Safe Inspector. A safety certificate will be issued prior to the tenancy commencing. We will also ensure the electrics throughout the property are checked by a qualified electrician. Most landlords have an NIC/EIC report which’s determines the safety of the electric`s within the property. Though other approved bodies can carry out tests in line with current regulations. A PAT (Portable Appliance Test) will be carried out on electrical items provided within the property. Smoke alarms are provided as standard, in addition to Fire Blankets and Fire Extinguishers. All furniture will be of a modern standard, meeting the BS 7177 kitemark. In short items of soft furnishing will have flame proof materials within.
In many cases we act as a managing agent when you take a property through us. We have trained property managers who act swiftly in the event of an emergency occurring and will answer all of your concerns appertaining to letting law and customer services.
What fees do i need to pay?
We cannot require a tenant (or anyone acting on their behalf or guaranteeing their rent) to make certain payments in connection with a tenancy. We cannot require them to enter a contract with a third party or make a loan in connection with a tenancy.
The only payments we can charge in connection with a tenancy are:
a) the rent
b) a refundable tenancy deposit capped at no more than five weeks’ rent where the annual rent is less than £50,000, or six weeks’ rent where the total annual rent is £50,000 or above
c) a refundable holding deposit (to reserve a property) capped at no more than one week’s rent
d) payments to change the tenancy when requested by the tenant, capped at £50, or reasonable costs incurred if higher
e) payments associated with early termination of the tenancy, when requested by the tenant
f) payments in respect of utilities, communication services, TV licence and council tax; and
g) A default fee for late payment of rent and replacement of a lost key/security device, where required under a tenancy agreement
Tenants are still responsible for paying bills in accordance with the tenancy agreement, which could include council tax, utility payments (gas, electricity, water) and communication services (broadband, TV, phone).
You must complete an application form by our chosen referencing agency, before we can begin the application process. This is used to carry out Credit Checks and Rent to Right Checks. In addition, you are required to show the following documents:
1. Photo I.D – Passport Copy or EU I.D Card
2. Three Months Bank Statement (Recent & within the last 3 months)
3. Employment Reference – Letter from employers & 3 months’ pay slips for each jobs
4. Account Reference– Letter from accountant to verify your company and Income statements (If self-employed)
5. Previous/Current Landlord Reference – Letter from landlord or letting agent stating good reference
6. Proof of address, i.e. any Utility Bill (Recent or within the last 3 months)
7. Character Reference (This can be done by a member of the family or any one in your work place)
8. Housing Benefit Letter – Confirming of receiving housing benefit from the council (If unemployed)
9. College or University letter – Confirming you are a student (If you study)
Once your application is successful, we will notify you and ask for you to pay your five weeks landlords security deposit and one month rent in advance. If you have paid a holding deposit of one weeks rent then this will be deducted from the five weeks landlords security deposit.
If you withdraw from the proposed tenancy for any reason whatsoever then this preliminary non-refundable holding deposit will be forfeited and applied in equal part to Crown Lets 4 u Ltd and to the landlord.
If you fail Rent to Right to Rent Checks by ourselves or our chosen referencing agency then this preliminary non-refundable holding deposit will be forfeited and applied in equal part to Crown Lets 4 u Ltd and to the landlord. When we retain the holding deposit, we will set out in writing the reason for this within 7 days of deciding not to enter the agreement or the ‘deadline for agreement’.
If the landlord withdraws from the proposed tenancy for any reason whatsoever, and this reason will not necessarily be disclosed to you by us or the landlord, then this holding deposit will be refunded to you by Bank Transfer at the earliest opportunity.
Once you have been given a references application form, we will retain your holding deposit if you or your guarantor provide false or misleading information which reasonably affects our decision to let the property to you (i.e. calls into question of your suitability as a tenant, this can include your behaviour in providing the false or misleading information), you fail a right to rent check, withdraw from the proposed agreement (decide not to let) or fail to take all reasonable steps to enter an agreement (i.e. responding to reasonable requests for information required to progress the agreement) when the landlord and/or agent has done so. If we wish to retain the holding deposit, we will set out in writing the reason for this within 7 days of deciding not to enter the agreement or the ‘deadline for agreement’.
All outstanding payments must be paid by Cash or Bank Transfer and payable to Crown Lets 4u Ltd or the Letting Agent Manager and Personal cheques WILL NOT be accepted. The outstanding amount by on-line bank transfer must be paid 5 days prior to moving in otherwise keys will not be released.
